On November 12th in The Gateway Pundit, in ‘DISQUALIFIED! – Congressman Eric Swalwell Names Washington DC Home as ‘Principal Residence’, I broke the story of Congressman Eric Swalwell’s ‘principal resident’ mortgage involving his home in Washington DC. Soon after Swalwell was referred to the Department of Justice over mortgage fraud allegations by Federal Housing Finance Agency Director Bill Pulte. He has made similar referrals against high-ranking democratic officials involved in mortgage fraud, including New York Attorney General Letitia James and California Senator Adam Schiff.
After declaring for California governor last Thursday, in an apparent effort to save his campaign, today Swalwell filed a civil lawsuit against Federal Housing Finance Agency Director Bill Pulte alleging violations of the Privacy Act and First Amendment. In the action, and even though Swalwell’s mortgage is publicly available online, Swalwell claims Pulte’s referral was based on politically motivated misuse of government databases. Swalwell claims that Pulte “used those records to concoct fanciful allegations of mortgage fraud, which he referred to the Department of Justice for prosecution.
In the lawsuit, Swalwell further claims “Representative Swalwell explicitly disclaimed any intent to occupy the District of Columbia home as his primary residence in a sworn affidavit attached to his mortgage agreement. That affidavit made clear that the home would be his wife’s primary residence – not his own.”
However, Swalwell’s sworn Deed of Trust contains no language whatsoever in which Eric Swalwell disclaims that the property will be his principal residence, nor does it include any affidavit, rider, or statement indicating that the home will be used exclusively by his wife or that he will not live there. Both Eric Michael Swalwell and Brittany Watts Swalwell are listed jointly as “Borrower,” they jointly sign the Deed of Trust, and the only affidavit they sign pertains solely to D.C. tax classification for a residential property. In short, the mortgage contains no disclaimer from Swalwell, and includes no language assigning the home to his wife alone.
Swalwell’s lawsuit appears to be a political advertisement as well. The very first sentence of Swalwall’s lawsuit states “Since taking office, President Trump has engaged in unprecedented efforts to leverage the power of the Federal Government to seek retribution against his political enemies.” Then it states “the past decade, Representative Swalwell has publicly and vigorously opposed President”.
In the suit, filed in federal court in Washington, DC, Swalwell is seeking damages and a court order directing Pulte to withdraw the criminal referral.
